Terms and Conditions for AI Service Usage

Introduction:

This document, referred to as the “AI Usage Policy”, outlines the terms under which users (“Users”) may utilize the artificial intelligence (AI) capabilities (“AI Features”) provided as part of our platform services (“Services”). These terms supplement the primary service agreement (“Main Agreement”) already in effect. Definitions for capitalized terms not specified in this document are determined by the Main Agreement.

User Obligations and Acknowledgements:

  1. General Usage: Users agree to abide by the Main Agreement and this AI Usage Policy while using the AI Features. The responsibility to adhere to these terms falls on Users and their permitted end-users. In case of discrepancies, the provisions of this AI Usage Policy will prevail.
  2. Risk Acceptance: Users recognize that AI, particularly generative AI, is a novel and evolving field. There may be unknown risks, and the technology’s safeguards may not be comprehensive. Users assume full responsibility for any risks arising from their use of AI Features, including but not limited to:
    • Legal Compliance: Users must ensure that their use of AI Features adheres to all relevant laws and regulations. There is a risk that AI Features or their outputs could be deemed non-compliant or illegal by authorities, possibly leading to service interruption or legal consequences.
    • Content Accuracy: Users accept that AI outputs may not always be accurate or appropriate. They are responsible for verifying the suitability and correctness of AI-generated content for their intended applications.
  3. Proper Conduct: Users must ensure their utilization of AI Features is lawful and does not infringe upon any third-party intellectual property rights. Additionally, Users must refrain from using AI Features to process or generate personal data unless it is adequately secured and permitted under applicable laws.
  4. Ownership and Use of AI-Generated Content: The content generated by the AI Features remains the property of the User, with the understanding that the User bears all responsibility for its legality, accuracy, and appropriateness. The platform provider claims no ownership over such content but also disclaims any warranties regarding its use or application.
  5. Content Review: It is the sole responsibility of Users to review, modify, and validate AI-generated content before its utilization or publication.
  6. External Services: The AI Features may incorporate or rely on services provided by external entities. Users should be aware that such third-party services, including those provided by OpenAI, LLC, are subject to their own terms and conditions.

Licenses and Permissions:

Users are granted a conditional, revocable, non-exclusive, non-transferrable license to access and use the AI Features in accordance with this AI Usage Policy and any applicable laws. This license does not extend to any form of sublicensing.

Data Handling and Intellectual Property:

The platform processes and generates data (“AI Data”) as part of its AI Features. Users are accountable for ensuring that AI Data complies with legal standards and respects intellectual property rights. The platform and third-party providers have no liability for inaccuracies or legal issues arising from AI Data.

Third-Party Providers and Services:

The AI Features may be powered by technology from third-party providers like OpenAI. Changes in third-party providers will be communicated to Users, and continued use of AI Features will constitute acceptance of these changes.

Disclaimer of Warranties and Limitation of Liability:

The AI Features are provided “as is” and without warranties. Users agree that the platform and its affiliates will not be liable for any direct or indirect damages arising from the use of AI Features.

Feedback and Improvements:

Users are encouraged to provide feedback on the AI Features. Such feedback may be used to enhance the platform’s services. Users grant the platform a perpetual license to use and incorporate their feedback.

Final Provisions:

This AI Usage Policy, together with the Main Agreement, constitutes the entire agreement regarding the use of AI Features. Users’ continued use of the AI Features signifies acceptance of these terms.
